Are you being paid the minimum wage? Did you know that the minimum wage is different depending on your region? It's $15 per hour in New York City, $13 in Long Island, and $11.80 upstate in 2020.
For every hour worked over 40 in a week, you are entitled to be paid at time and a half your base rate of pay. That means, if you make the minimum wage of $15 in NYC, your overtime should be $22.50.
Does your employer pay you for all the time you work? Do you have to clock-out early and still work without pay? Common issues include not being paid for every hour you worked, being paid late, having your employer's check bounced, rounding your hours on paychecks, or taking a tip credit without authorization
are you paid not on an hourly basis? Most workers in New York have a right to be paid on an hourly basis. That means that if your employer pays you a flat rate (for example, $500 per week, or $100 per day), you could be entitled to more compensation.
Your employer MUST give you written notice before they can deduct a "tip credit," and if you did not receive this notice, you could be entitled to several dollars per hour for each hour you worked in damages.
Did your employer make you wear a uniform? Odds are, you are entitled to additional pay each week. And you should never, ever have to pay for your uniform.
